Leaders in immigration dove into the latest fee schedule recently unveiled by USCIS. They covered how the new fees will impact various immigration processes including citizenship applications, DACA renewals, fee waiver eligibility, adjustment of status filings, and asylum petitions.

USCIS will be at new FEMA Disaster Recovery Relief Center 8.30-9.9
U.S. Citizenship and Immigration Services (USCIS) will be at a new FEMA Disaster Recovery Center (DRC) located at the Lahaina Civic Center (1840 Honoapiilani Hwy (HI-30)). Please note the dates, times, and locations for USCIS services.
(8/30): USCIS will provide services until 4:00 p.m. at the DRC located at University of Hawaii Maui College, 310 W. Ka’ahumanu Avenue, Kahului, Hawaii.
(8/31): From 1:00 – 7:00 p.m., USCIS will provide services at the DRC located at the Lahaina Civic Center (1840 Honoapiilani Hwy (HI-30)).
Friday-Friday (9/1-9/8): From 8:00 a.m. – 7:00 p.m., USCIS will provide services at the DRC located at the Lahaina Civic Center.
Saturday (9/9): From 8:00 a.m. – 1:00 p.m., USCIS will provide services at the DRC located at the Lahaina Civic Center.

Brissa Flores Featured Speaker at the Women's Fund of Hawaiʻi

Former TLC Program Coordinator Brissa Flores was recently invited to be the featured speaker at the Women’s Fund of Hawaiʻi (WFH) benefit event. Brissa, who was born in Mexico and raised in California, spoke about her journey to pursue a law degree at the William S. Richardson School of Law, which included being the first in her family to speak English fluently and the first to graduate from college. Mahalo to WFH for its funding support of TLC’s work.

Legal Team Outreach to Hawaiʻi Island

TLC senior attorney Omar Vaquerano and paralegal Lia Nakao traveled to Hawai’i Island to expand outreach and establish relationships with community service providers on neighbor islands. In Hilo, Omar and Lia joined Tulpe Day of the Hawaiʻi County Office of Immigration Services and Linda Spencer of Catholic Charities-Hilo in leading a public presentation on family-based immigration issues and providing in-person consultations to attendees. In Kona, TLC's legal team met with community healthcare workers at West Hawai’i Community Health Center and provided legal counsel to Spanish-speaking patients in need of immigration services. The trip was successful in providing access to legal services to constituents beyond Oʻahu, with TLC agreeing to represent eight new clients on Hawaiʻi Island.

Happy Citizenship Day!
Milagritos 'Mily' Martinez is a resident of Kailua, Hawai’i. She has been living on O’ahu for a little over 3 years. TLC assisted her with her Naturalization (N-400) application and accompanied her to the oath ceremony. Mily is originally from Peru and came to the United States in 2016. Mily was petitioned by her mother to come to the U.S. She was on the waitlist for 8 years, anticipating the chance to reunite with her family. She wanted to become a U.S. citizen because of how welcoming America was to her and her daughter, providing her the opportunity of a new life and a fulfilling job.
Some words from Mily on her naturalization: “I would like to share that I have felt extremely advised and accompanied in the process by The Legal Clinic. I was afraid to apply, and I just thought I would not lose anything by trying... There are three opportunities to take the test, however I passed my interview on the first appointment. I encourage those who meet the requirements to take the first step of becoming citizens of the United States. Thank you very much to The Legal Clinic and all the wonderful and professional people who work there.”

The Vital Role of Interpreters and Employer Advocacy at a Client’s Hearing
In November 2023, TLC attorney Neribel Chardon advocated for one of TLC’s clients in immigration court. The client, a native and citizen of Philippines, is a grandmother and a longtime legal permanent resident. She was detained and placed in removal proceedings upon returning from a family funeral visit abroad. The client’s native language is Ilocano. As such, to guarantee her due process right, the Immigration Court needed to provide her with a language interpreter. However, the client’s individual hearing was delayed for five months because of the limited availability of interpreters for the Immigration Court. In the meantime, the client remained separated from her family, unable to work and take care of her ill husband. After diligently trying the case in court, TLC’s legal team was successful in obtaining the cancellation of removal and release from detention.
The client's employer, an owner of a well-established Honolulu restaurant, served as a key witness during the hearing and highlighted the client's contributions to their business, the community and the local economy. The employer's testimony played a pivotal role in the court's decision. The granting of the cancellation of removal order was not just a legal triumph but a moment of profound joy and relief for the client and the family.

Ukrainian Family Obtains Green Cards
On February 24, 2022, the war in Ukraine forced my wife, our daughter, and me to flee our homeland. Seeking refuge, we initially traveled to Poland to stay with a friend for a month. During our stay, we learned of the opportunity for Ukrainians to seek a better life in America. After much discussion, our family decided to take the chance. Our journey began when we left Poland, flying to France, then to Mexico, and eventually reaching Tijuana. From there, we crossed the border into San Diego on foot, marking our arrival in the United States. Through Facebook, we were able to connect with compassionate and generous individuals who offered to let us stay with them at their residence in Hawaiʻi. Before we fled from the war in Ukraine, I filled out an application for the diversity visa lottery. After relocating to Hawaiʻi, I discovered that I had been selected for the lottery! We tried applying for the green card on our own but were overwhelmed with the number of documents we needed to complete, so we turned to The Legal Clinic for assistance. We were so glad we found them because we thought we had completed all the steps, but learned we were still missing the most important part of the application! Without The Legal Clinic's timely help in taking the final step, we would have lost our opportunity to get our green cards. TLC’s attorney, Omar Vaquerano, and legal assistant, Lia Nakao handled our case with professionalism and provided invaluable guidance. When our family was scheduled for an interview with USCIS, Omar was by our side, diligently overseeing our case. Thanks to the assistance of The Legal Clinic, we were able to secure our green cards, opening the door to a brighter future.

Russian Protester Granted Asylum in Hawaiʻi Following Arduous Journey

Our client, a highly educated citizen of the Russian Federation from Siberia's Buryatia region, found himself at a crossroads. He had to make the difficult decision to leave Russia due to concerns for his safety, primarily stemming from his vocal criticism of the Russian government's policies. His decision was made after a peaceful picket protest against the Russian government's war in Ukraine, which led to his detainment by Russian authorities. He embarked on a challenging journey, traveling on foot through Mexico to reach the U.S. border, where he faced removal proceedings. He then went to Charlotte, North Carolina, where he encountered numerous obstacles, including a lack of support and difficulties navigating the process of applying for asylum. Eventually, he moved to Hawaiʻi, where he experienced homelessness and was even hit by a car, leaving him with injuries that required months of recovery. In Hawaiʻi, lacking the financial resources to secure legal representation, our client turned to The Legal Clinic (TLC) for assistance. After seven months of thorough preparation, TLC's attorney, Omar Vaquerano, presented his case before the Honolulu immigration court. The case was particularly challenging, as it hinged on the argument that our client faced a well-founded fear of future persecution, given that his prior detention in Russia was not severe enough to argue that the government’s past actions rose to the level of persecution. TLC's attorney was able to successfully make this argument at the merits hearing, and the judge granted the client's asylum application. Our client now has access to essential benefits like cash assistance, housing, and employment opportunities. This achievement marks the beginning of a new chapter in his life with the possibility of lawful permanent resident status in the future.

Two New Citizens in One Day
TLC is proud to celebrate two of our country’s newest citizens! TLCʻs Lia Nakao helped provide Estrella with study materials for the citizenship exam. Estrella says she is happy to be an American citizen and that she was so grateful for the support from TLC throughout the application process. Her husband, Jose, was sworn in as a US citizen two weeks later, and they hope to soon be renuited with their son from the Philippines, who is also applying for US citizenship.
